GO Group Digital GmbH (“GOGroupDigital” or “we”) provides the content on this Web site (the “Site”) subject to the following terms and conditions (the “Terms”). We may periodically change the Terms, so please check back from time to time. By accessing and using this Site, you agree to these Terms. For an explanation of GOGroupDigital’s practices and policies related to the collection, use, and storage of our users’ information, please read our Privacy Policy.

1. SITE CONTENT AND USE

All content and functionality on the Site, including text, graphics, logos, icons, and images and the selection and arrangement thereof (“Site Content”), is the exclusive property of GOGroupDigital, its affiliates or its licensors and is protected by European Union and German copyright laws. The trademarks, service marks, designs, and logos (collectively, the “Trademarks”) displayed on the Site are the registered and unregistered Trademarks of GOGroupDigital, its affiliates and its licensors. All rights not expressly granted are reserved.

Any reproduction or redistribution of the Site Content and functionality displayed on the Site in whole or in part, is expressly prohibited by law, and may result in criminal or civil fines. You may not reproduce, modify, distribute, transmit, post, or disclose the Site Content without GOGroupDigital’s prior written consent. You agree that you will not refer to or attribute any Site Content to GOGroupDigital or its affiliates or licensors in any public medium (e.g., press release, Web sites) for advertising or promotion purposes or for the purpose of informing or influencing any third party, and that you will not use or reproduce any Trademark of, or imply any endorsement by or relationship with, GOGroupDigital or its affiliates or licensors.

2. NOTICES OF INFRINGEMENT

GOGroupDigital prohibits the posting of any content that infringes or violates the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity. If you believe that your intellectual property right (or such a right that you are responsible for enforcing) is infringed by any content on the Site, please write to GOGroupDigital at the address shown below, giving a written statement that contains: (a) identification of the copyrighted work and/or intellectual property right claimed to have been infringed; (b) identification of the allegedly infringing material on the Site that is requested to be removed; (c) your name, address, and daytime telephone number, and an e-mail address if available; (d) a statement that you have a good faith belief that the use of the copyrighted work and/or exercise of the intellectual property right is not authorized by the owner, its agent, or the law; (e) a statement that the information in the notification is accurate, and, under penalty of perjury, that the signatory is authorized to act on behalf of the owner of the right that is allegedly infringed; and (f) the signature of the intellectual property right owner or someone authorized on the owner’s behalf to assert infringement of the right. GOGroupDigital will remove any posted content that infringes the copyright or other intellectual property right of any person under Canadian law upon receipt of such a statement.

4. THIRD-PARTY WEB SITES

We may provide links to third-party websites, and some of the content appearing to be on this Site is in fact supplied by third parties, for example, in instances of framing of third-party Web sites or incorporation through framesets of content supplied by third-party servers. GOGroupDigital has no responsibility for these third-party Web sites, which are governed by the Terms of Use and privacy policies, if any, of the applicable third-party content providers.

5. GOVERNING LAW; JURISDICTION

These Terms are governed by the laws of the Commonwealth of Massachusetts without reference to the principles of conflicts of laws thereof. Any dispute arising from these Terms shall be resolved exclusively in the state and federal courts of Republic of Germany.

Privacy Policy

This Privacy Policy applies solely to information collected through the web site located at the URL: www.GOGroupDigital.com; whether accessed via computer, mobile device or other technology. The Site is offered by Global Optimization Group GmbH LTD d/b/a GOGroupDigital (“GOGroupDigital”, “we”, “us”, “our”).
This Privacy Policy explains what information may be collected through the Site, how such information may be used and/or shared with others, how we safeguard it and how you may access and control its use in connection with our marketing communications and activities.

GOGroupDigital strives to collect, use and disclose user data in a manner consistent with the privacy and data security laws of the countries in which it does business. 1. INFORMATION COLLECTED ON OUR SITE

Information You Provide To Us

When you use the Site, we or our service providers may collect Personal Information (information that could reasonably be used to contact you or to identify you personally) such as your name, e-mail address, telephone number or mailing address. We may also collect Personal Information submitted to us in connection with job applications through the Site.

Information Collected Automatically

Usage Information. Whenever you visit or interact with the Site, GOGroupDigital, as well as any third-party advertisers and/or service providers, may use a variety of technologies that automatically or passively collect information about how the Site is accessed and used (“Usage Information”). Usage Information may include, in part, browser type, operating system, the page served, the time, and the preceding page views. This statistical data provides us with information about the use of the Site, such as how many visitors visit a specific page on the Site, how long they stay on that page, and which hyperlinks, if any, they “click” on. This information helps us keep our website fresh and interesting to our visitors and tailor content to a visitor’s interests.

Device Identifiers. GOGroupDigital may also automatically collect your IP address or other unique identifier (“Device Identifier”) for the computer, mobile device, technology or other device (collectively, “Device”) you use to access the Site. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Site, help diagnose problems with our servers, analyze trends, track users’ web page movements, help identify, and gather broad demographic or firmagraphic information for aggregate use.

Cookies; Pixel Tags. The technologies used on the Site to collect Usage Information, including Device Identifiers, may include but are not limited to: cookies (data files placed on a Device when it is used to visit the Site), mobile analytics software and pixel tags (transparent graphic image, sometimes called a web beacon or tracking beacon, placed on a web page or in an email, which indicates that a page or email has been viewed). Cookies may also be used to associate you with social networking sites and, if you so choose, enable interaction between your activities on the Site and your activities on such social networking sites. We, or our vendors, may place cookies or similar files on your Device for security purposes, to facilitate site navigation and to personalize your experience while visiting our Site (such as allowing us to select which content, ads or offers are most likely to appeal to you, based on your interests, preferences, location, or demographic or firmagraphic information). A pixel tag may tell your browser to get content from another server.

2. HOW WE USE THE INFORMATION COLLECTED THROUGH OUR SITE

Third Parties. In order to carry out your requests, to make various features, services and materials available to you through the Site, and to respond to your inquiries, we may share your Personal Information with third parties that perform functions on our behalf, such as companies or individuals that: host or operate our Site; analyze data; provide customer service; advertisers; sponsors or other third parties that participate in or administer our promotions. Your Personal Information may also be used by us or shared with our affiliates, sponsors, partners, advertisers or other third parties, including lead generation companies to provide you with product information and promotional and other offers.

Your Agreement To Have Your Personal Information Shared. While on our Site, you may have the opportunity to opt-in to receive information and/or marketing offers from someone else or to otherwise consent to the sharing of your information with a third party. If you agree to have your Personal Information shared, your Personal Information will be disclosed to the third party and the Personal Information you disclose will be subject to the privacy policy and business practices of that third party.

Business Transfers. Your Personal Information may also be used by us or shared with our subsidiaries, affiliates and other entities in the Publicis Groupe family of companies for internal reasons, primarily for business and operational purposes. As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all or substantially all of our assets, or assets related to the Site, Personal Information, Usage Information, and any other information that we have collected about the users of the Site may be disclosed to such entity as part of the due diligence process and will be transferred to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Legal Disclosure. GOGroupDigital may transfer and disclose information, including your Personal Information, Usage Information and Device Identifier, (including IP address), to third parties to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our Terms of Use or other applicable policies; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to our Site or the public.

4. YOUR CHOICE AND ACCESS

You may always direct us not to share your Personal Information with third parties, not to use your Personal Information to provide you with information or offers, or not to send you newsletters, e-mails or other communications by: (i) sending us an e-mail at privacyofficer@gogroupdigital.com; (ii) contacting us by mail at GO Group Digital GmbH. Your opt-out request will be processed within 30 days of the date on which we receive it.

If you wish to verify, correct, or update any of your Personal Information collected through the Site, you may contact us at the above address or e-mail. In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Site. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.

5. CHILDREN.

The Site is not directed to children under 13. We do not knowingly collect Personal Information from anyone under 13 years of age. If we determine upon collection that a user is under this age, we will not use or maintain his/her Personal Information without the parent/guardian’s consent.

6. SECURITY OF YOUR INFORMATION

We use certain reasonable security measures to help protect your Personal Information. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use the Site and provide us with your information at your own risk.

7. OTHER SITES.

The Site may contain links to other sites that we do not own or operate. This includes links from service providers, advertisers, sponsors and partners that may use our logo(s) as part of a co-branding agreement. We do not control, recommend or endorse and are not responsible for these sites or their content, products, services or privacy policies or practices. These other web sites may send their own cookies to your Device, they may independently collect data or solicit Personal Information and may or may not have their own published privacy policies. You should also independently assess the authenticity of any site which appears or claims that it is one of our Sites (including those linked to through an email or social networking page).

8. CONSENT TO PROCESSING

The Site is operated in Canada and in accordance with the laws of Canada. We make no representation that the Site is governed by or operated in accordance with the laws of any other nation. If you are located in the European Union, the United States or elsewhere outside of the United States, please be aware that information we collect may be transferred to and processed in Canada.
